The Tyranny of Lawfare (March 1st)

Lawfare, weaponizing the courts and judicial branch against American citizens. The world is watching a comprehensive lawfare strategy waged against President Trump in an attempt to determine the outcome of the 2024 election. It is the most obvious case, but lawfare goes much, much deeper and has been employed by the left in not so obvious ways that are steadily chipping away at our rights, freedoms, security, wealth, and even basis of governance.

You may have heard of Steve Baker, who turned himself in to the FBI today on an outstanding warrant for trespassing at the Capitol on January 6. Baker is a journalist for Glen Beck's Blaze network. He didn't riot, he didn't destroy anything, he took pictures and reported on what was happening in the Capitol. It is all on film. In other words, he told the truth and blew up the government's narrative about what happened that day, and therefore he must be punished, incarcerated, and silenced.

Catherine Herridge is one of the leading journalists covering national security issues in Washington. She was recently fired from CBS News and is now subject to a lawsuit that is attempting to out her confidential sources in her coverage of Crossfire Hurricane from 2017, which means she was uncovering the truth and squarely over the target. Herridge has demonstrated journalistic integrity and accuracy every step of the way. This morning Obama judge Christopher Cooper cited "safeguarding judicial authority" as the reason for holding Herridge in contempt of court, and is fining her $800 a day for not outing her sources.  

Baker and Herridge were legally doing their job, a job that has been granted a specific carve out by the first amendment to inform we the people what the government is doing. The Biden administration is using lawfare to censor and intimidate journalists and critics, and lie to the American people. 

New York AG Leticia James filed a dissolution lawsuit against the NRA, who at that time was headquartered in New York, in 2020, a blatant attempt to shut down a huge conservative lobby and defender of the second amendment. A jury found the NRA not guilty of 14 of the 16 counts in the suit. The remaining two counts were ruled against the NRA to the tune of $7.4 million. Starting March 18, the Supreme Court will hear arguments in the NRA vs Vullo case. Maria Vullo was the head of the New York Department of Financial Services during the Cuomo administration, who tried to use the power of the state to bankrupt and silence the NRA.  Good for the NRA for fighting back.

James has also filed suit against JBS USA, the world's largest producer of beef, citing "greenwashing," meaning that the company is not moving toward net zero emissions quickly enough and is lying because the company's net zero goals are "not feasible."  James in her filing states "families continue to face the impacts of the climate crisis" and will "spend more of their hard-earned money on products from brands that are better for the environment." Oh, really.....     

Marc Elias and his Elias Law Group just won a federal lawsuit on behalf of left-wing activist groups MiFamiliaVota and Votolatino, that strips the state of Arizona of the ability to verify citizenship for voter registration, a direct challenge to the 1st and 14th amendments. The left wants to take this nationwide, and if successful the nation will devolve into one party mob rule. 

Left wing environmental activists have colluded with the Biden administration to effectively destroy our energy and manufacturing sectors through federal lawsuits. The strategy is brilliant in practice. Here is how it works...

Enviromental Groups like WildEarth sue the administration over oil exploration, mining, or manufacturing, and the sympathetic Biden bureaucracy and cabinet then winks and settles with the activists; thereby crippling our energy and manufacturing sector, harming us strategically, enriching China, Russia, and OPEC, and paying attorney fees with our tax dollars to the activist law firms that further fuel the strategy. It has happened over and over. Recently 4 million acres were ceded and deemed off limits to energy exploration as a result of a settlement. That's more land than the state of New Jersey.

It is redux of a gambit the Obama administration used to shake down the major banks and mortgage companies, which bankrolled the left's ground game that has paid them so many dividends in elections nationwide. You can call it "sue and settle," and it is killing the energy and manufacturing sectors and as you can see with the James suit, they are coming for the food supply too. It is hardly covered in the media. Subtle lawfare, and the fleecing of our nation right under our noses. 

In Federalist #78, Alexander Hamilton wrote that the judiciary should be independent, and "designed to be an intermediate body between the people and the legislature in order to ensure that the representatives acted only within the authority given to the congress under the constitution." A co-equal branch, a referee, an arbiter. That was the original intent.

Lawfare changed all that. Activist courts have usurped the state and federal legislatures, the will of the people, and are a partisan political blunt force instrument of the left, a defacto government unto itself.  Along with the invasion at our southern border, lawfare, the politization, and weaponization of the judiciary is the greatest threat to our constitutional republic, upsetting our carefully crafted balance of power. Lawfare is the real insurrection, a bloodless coup by rulers in robes, in collusion with activists, all unelected and unaccountable, and at its core unamerican. Lady Liberty's blindfold has been ripped off, thrown down, her scales trampled... The greatest despots in world history would be so proud.
